
Nineteen-year-old student Marcellus Andrews died when a group of guys approached him, called him a “faggot” and repeatedly kicked him in the head. The attack happened on August 19th and now police have finally made an arrest. Police have charged 19-year-old Paris Akeem Anding with second-degree murder and held him without bond.
The police will not charge any of Andrews’ attackers with a hate crime, partially because they believe the attack culminated over past events and partially because Andrews’ family says Andrew was not gay (even though he totally was).

Whether or not the victim was gay is irrelevant to whether or not it was a homophobic hate crime. What matters is whether or not homophobia was the motive – and I cannot see how anyone can claim that homophobia wasn’t the motive in this case.
From what I remember of the Matthew Shepard Act, the FBI can take over an investigation from the state police if the case should be dealt with as a hate crime and the state police aren’t – i.e. exactly the situation we have here.

Where is the evidence it was a anti gay hate crime? Most of the young Black guys I know use the word”fa##ot as a insult even moreso with a straight guy. All these famous athletes that have called fans/officials etc fa##ots didn’t perceive them as gay. They just know the worst thing you can call a target/enemy is that word.If this suspect used to date the victim or if the victim stole drugs from the suspect or dissed the suspect. Would you consider it a hate crime simply because the suspect and his friends used the term fa##ot? Maybe I’m missing something.

Ever since they made hate crimes legislation “Job #1,” it seems like there’s just no such thing as an antigay hate crime.
I guess just enacting the Matthew Shepard Act solved the problem.
