The The Dallas Morning News has much better coverage than the badly sourced Gawker article. Two points: The fact that his spit isn't actually a deadly weapon is meaningless in this case because he intended it to be so. Secondly, his sentence is more about the fact that he had to be restrained and removed from the court room in the presence of the Jury, than the crime he was convicted of. That kind of behavior is what causes those 12 people to ask each other if they want that guy walking around on the street.
