CA Attorney General to Respond to Suits Over Prop. 8 Today

California Attorney General Jerry Brown has until noon today to repsond to suits filed by marriage equality activists that seek to overturn Prop. 8. The question at hand is not whether the Proposition is valid, but whether the Supreme Court should accept the suits. Members of the Yes on 8 campaign have so far been unsuccessful in being added as parties to the suit. They are concerned that Brown won’t be aggressive enough in fighting the suits. [NBC]

Can someone at Queerty contact a lawyer in California? I thought that major changes to the Constitution of California were supposed to go through the legislature BEFORE questions are put on the ballot.

IF this is true, then the CA Supremes should have never let this question on the ballot. Can we get a definitive answer on this? Thanks.

@Jaroslaw: That’s the argument being made now. I have some “explaining the legal process” pieces coming up, but basically, the Supreme Court can’t rule on a Prop. if it hasn’t passed yet, so tat’s why these arguments are only happening now.

Um, that’s exactly the legal argument for the lawsuits mentioned in this story.

So yes, we’ll get a definitive argument on this – when the Supreme Court decides these cases.

OK, Japhy, I sort of do and sort of don’t understand what you’re saying.

There was a motion by Lambda legal to keep this question off the ballot (which I think the court ruled against).

So, if this is supposed to be the standard procedure, why does it need to be re-decided for each proposal?

You guys are late! The PortectMarriage.Com has been allowed into the lawsuit as well as Jay Sekulow Live and the ACLJ! Yes on Prop 8 is where its at baby!!!!

Marriage is between one man and one woman for life! Even one of your Frat Brothers, Elton John says so!
