A ruling from the California Supreme Court on the constitutional legality of Proposition 8 could come as soon as this week, according to court spokeswoman Lynn Holton. The ruling would be a response to three lawsuits filed immediately after Prop 8. passed one week ago today that argue that the ballot initiative process was followed improperly. The court overruled an earlier Proposition, Prop. 22 in May that defined marriage as between a man and a woman, but as the Washington Post reports this morning:

"Legal experts say this time the proposition would not be as easy to overturn. Unlike Proposition 22, which in 2000 created a statute that was trumped by the state constitution, Proposition 8 is part of the constitution.

Gays are the new John Conner. Yesterday, Governor Arnold Schwarzenegger spoke out in opposition to Prop 8., which… oh you know what it did, already. The Boston Globe reports:

In past statements, he has said he believes marriage should be between a man and a woman and he has rejected legislation authorizing same-sex marriage. Yet he also has said he would not care if same-sex marriage were legal, saying he believed that such an important societal issue should be determined by the voters or the courts.

Schwarzenegger publicly opposed Proposition 8, which amends the state Constitution to declare that "only marriage between a man and a woman is valid or recognized in California."

Yesterday, he urged backers of gay marriage to follow the lesson he learned as a bodybuilder trying to lift weights that at first were too heavy for him. "I learned that you should never, ever give up. . . . They should never give up. They should be on it and on it until they get it done."

His eyes glowing red, Arnold then set off for the Yes on 8 headquarters, muttering to anyone within earshot, "I'll be back." Don't tell me Terminator references get old. They never do.

The minute-long spot first highlights how Reagan, while Governor of California, opposed to the Briggs Initiative - a measure that would have banned gays from teaching in the Golden State's public schools. That pro-gay stance, says the narrator, can be directly compared to current California Governor Arnold Schwarzenegger's pledge to vote against Proposition 8.

If Reagan can't woo the right, no one can!

California Governor Arnold Schwarzenegger yesterday vetoed a bill implementing Harvey Milk Day, which is named after the state's first openly gay elected official. Schwarzenegger, a former actor, says he thinks the event shouldn't be celebrated statewide. "[Milk's] contributions should continue to be recognized at the local level." [AP]

California's Log Cabin Republicans are flexing their muscle. The gay group's joined forces with Governor Arnold Schwarzenegger to smack down Proposition 8:

Today, Log Cabin sent a message out to its California membership announcing the creation of Republicans Against 8, a coalition of concerned Republicans who believe in limited government and individual liberty. Our goal is to reach out to that 5-6 percent of persuadable Republican voters and convince them that, regardless of how they feel about marriage, protecting fundamental freedoms for all Californians is more important.

In 1978, when the Briggs Initiative threatened to take away the fundamental freedom for all Californians to teach in Public Schools, Governor Ronald Reagan stood up and opposed it. Today, another Republican Governor, Arnold Schwarzenegger, is fighting for the rights of all Californians once again.

San Francisco Mayor Gavin Newsom, who famously - and illegally - began issuing same-sex marriage licenses back in 2004, has launched an exploratory bid for California's gubernatorial seat. "His move placed the 40-year-old, two-term mayor out in front of a large Democratic field eyeing the race to succeed Republican Arnold Schwarzenegger, who is barred by term limits from running again in 2010. Newsom said he expected to decide by year's end whether to proceed with a full-fledged candidacy." [LA Times]

California governor and former actor Arnold Schwarzenegger reiterated his support of gay marriage on yesterday's Meet The Press: "I personally believe that marriage should be between a man and a woman. But at the same time I think that my, you know, belief, I don't want to force on anyone else, so I think we should stay with the decision of the Supreme Court and move forward. There are so many other more important issues that we have to address in California. So I think to spend any time on this initiative I think is a waste of time." [MSNBC via Joe.My.God]

There may be more to Arnold Schwarzenegger's gay marriage story.

The California Governor last week came out for same-sex nuptials, saying that battling an amendment banning gay marriage would be a waste of time. The move surprised many, of course, especially considering that he has twice vetoed legislation that would allow homos to seal the deal. The former actor's staff later reiterate an earlier statement: the Governor will uphold the Supreme Court's ruling on the controversially pro-gay laws. Justices have been deliberating since March.

While we could call Schwarzenegger's recent declaration political evolution, some say that the Supreme Court has internally passed the marriage matter and the Governor's just trying to lay the foundations for a conservative uprising.

Arnold Schwarzenegger's the man of the gay news hour at the moment.

The Republican Governor of California caused a stir when he told the Log Cabin Republicans that he opposes an amendment banning gay marriage.

I will always be there to fight against that. I think we need a constitutional amendment so that a foreign-born (person) can run for president, but not against gay marriage. That would be a total waste of time.

Schwarzenegger has previously vetoes bills legalizing gay nuptials, which, of course, is in line with his Republican peers. Unlike other GOP members - like presidential candidate John McCain - Schwarzenegger says the Supreme Court should decide the legality of the situation.

The gays, of course, are thrilled about this turn of event. Equality California executive director Geoff Kors gushed, "This is extremely significant, and it's an enormous event to have our Republican governor come out against this ballot measure, which is opposed by Democrats as well. It makes this opposition a bipartisan issue." Social conservatives aren't as enthusiastic, but that's alright: society can evolve without them.

Apparently Republican Californian Governor Arnold Schwarzenegger came out against a ban on same sex marriage, although it seems a bit soft to us: "Schwarzenegger came out against a ballot measure circulating in California to add a gay marriage ban to the State Constitution. Stating that he “will always be there to fight against that,” Schwarzenegger made one of his first pubic statements about the initiative constitutional amendment in circulation." [Boi From Troy]

The Log Cabin Republicans are gearing up for their annual convention in San Diego this weekend, when luminaries like Arnold Schwarzenegger will address the gay GOPpers. One of the group's members, Kevin Norte, offered this reflection, which we think is fairly valid: "The gay and lesbian community is more accepting of, lately, the leather community than it is the Republican community. West Hollywood will put Mr. Leather as their grand marshal of the parade, but would they ever put a Republican? The answer is Never! And that's a boundary that has to be broken down someday." There's certainly quite a talent pool to choice from - we think Mark Foley would make a great grand marshall. Just make sure there are no teenagers around. [KPBS]

Kevin Broadwater, the domestic partner of James Vaughn, Director of the California Log Cabin Republicans, has been appointed by the Governor to the State Independent Living Council.

Vaughn was appointed last year by Governor Schwarzenegger to the California State Bar Board of Governors Examining Committee. This marks the first time that a gay Republican couple has served in an administration.

Hubby Arnold Schwarzenegger may like John McCain, but Kennedy cousin Maria Shriver and her teeth stick with Teddy, Caroline and Patrick in endorsing Barack Obama.

Governor Arnold Schwarzenegger signed an anti-discrimination bill into law earlier this year. That law says it's unlawful for school's to discriminate against and exclude gays from higher education. The move sparked conservative outcry of gay infiltration and a larger plot of "force fed" homosexuality.
