Did Obama Add a (Gay Marriage Loving) Dude to His SCOTUS List?

The latest update on President Obama's pick list for Supreme Court justices doesn't have Kathleen Sullivan and Pam Karlan's names on it. But it does sport one new, very interesting addition:

A man.

A man who loves gay marriage!

Among the names of Solicitor General Elena Kagan, Michigan Gov. Jennifer Granholm, Homeland Security Secretary Janet Napolitano, and U.S. Appeals Court judges Sonia Sotomayor and Diane Pamela Wood is … California Supreme Court Justice Carlos Moreno.

And wouldn't you know it: "Moreno is the only Democrat on the California Supreme Court and is widely regarded as its most liberal voice. Last year he signed on to the court's 4-3 ruling that legalized gay marriage in the state." (And then voters had to go muck things up.)

Moreno is also, like David Souter who he's replacing, an old white guy with pigment-deficient hair.

I see this choice as a good thing but then at the same time I don't. This is because if Obama appointed Carlos to the Supreme Court Arnold would appoint a more right leaning Justice.

Carlos Moreno is a Mexican-American old white guy…. aka would be USA's first hispanic justice…….kinda much bigger of a deal than just another "old white guy"

He sounds great – for the next pick, if there is one. We need another woman on the supreme court. There is only one, and she's sick. And if he is that gay friendly, as atdleft said, he needs to stay in CA for the forseeable future.

The "white guy" comment is the story is really obnoxious, and it's part of parcel of the attitude that lost us the Prop 8 fight. As a poll worker I was sent to Santa Monica, and they sent no one to East LA.

If we want people to be sensitive to our rights and issues and lives, then shouldn't we be sensitive to theirs in return?

The words "white" and "black" when used in a racial context mean a particular ethnicity not skin color. A light-skinned African-American will indentify as being "black" because they belong to that culture. Similarly a light-skinned hispanic cannot be called "a white guy" when he relates to Mexican-American heritage.

@Oaklander: We agree to disagree, but in my opinion Arnold would appoint a more right leaning Justice. He has already vetoed every marriage bill that came to his desk…I wouldn't call Arnolds wishy washy record on LGBT issues "fairly progressive".

He vetoed those legislative votes because they WERE NOT LEGAL VOTES. They would've been rendered useless by proposition 22, until the SCOCA reviewed the law. People don't like to include this when they talk about Arnold's record on the issue.

At this point, I wouldn't know which kind of judge Arnold would pick, but I wouldn't base anything on those vetoes. Moreno would be a huge loss to us on that panel though…he may be the only one to vote to uphold prop 8.

I'm amazed when folks believe their own spin. He has signed nearly everything that has been supported by Equality California. He has a better record than Gray Davis.

He's vetoed the two "overturn prop 22" bills – and I agree with his assessment – and the Harvey Milk Day bill about which I don't care in the slightest. Everything else that has ANY impact on gay Californians he's supported.

And have you looked at any of his other appointments? Or his advisors or staff?

"Big evil awful homophobic Republican" Schwarzenegger's last Supreme Court appointment is a lesbian. And, for those who care just a tiny bit about facts, he is on record as supporting marriage equality, opposed Prop 8 (though not as much as we'd like), and has said that he hopes the Court overturns it.

I don't fear Arnold's appointments. Because I actually know his record and don't fall victim to stupid party-think.

And I suspect Alex that if Arnold changed the letter behind his name from R to D you would think he was the second coming.

FYI, folks. The Prop 8 decision must be declared by the first week in June. I don't think we need to worry that Moreno will be approved by the Senate by then.

Look at the guys record before you are so dismissive. He is a strong supporter of gay rights and works tirelessly on child welfare/foster care issues.

Justice Moreno would make an excellent addition to the US Supreme Court.

I am usually amused by your website. This assessment of Justice Moreno as old and white is not funny, not necessary, and frankly, rude .

The man signed marriage equality in California. What more do you want??? Elena Kagan is also a SUPERB choice for the LGBT community. She's more leftist than Ruth Bader Ginsburg!!! These are perfect choices for the court!

And let me say this…

We don't need a gay justice on the court. What we need is a justice who will acknowledge our rights and who will interpret the constitution to reflect those rights.

Someday we will have a gay justice. Until that day comes, let's not get all uppity and bitchy. If Obama appoints a Clarence Thomas or a "civil unioncrat" Governor THEN we can be outraged!

Another point. Moreno is a Jew. For some odd reason, support for gay marriage appears to be quite popular in the Jewish community. Just as it's opposed by the Christian community.

@vext: I agree in west hollywood where I live there is a great synagogue that does a lot of gay family functions weddings (til prop 8) bris's of gay families babies etc. Although more progressive christian churches are FINALLY beginning to step up to the plate. It is important to me that the appointee be a believer of marriage equality it says a lot about his or her sense of justice.

Leola McConnell is correct: Bush applying pressure (continuously criminally stalking Margie Schoedinger) purposefully to force Schoedinger to commit suicide does in fact constitute murder where it culminated in her death.

BEWARE: If the president of the United States hates one—for whatever reasons—he can continuously criminally stalk one to the point that one cannot get away from it, and one ultimately commits suicide in desperation to escape. He can murder people in this way.

Bush is getting away with his murder of Schoedinger—with no sheriff, prosecutor, or court willing to uphold the rule of law.

Bush’s method of murdering Schoedinger cannot exist in a vacuum: he must have murdered other people in the same way.

Bush should confess, come out with the names of all of the people whom he murdered in the disgusting way he murdered Schoedinger, undergo execution, and accordingly find himself at the intersection where he would be free.
