A Florida man has admitted to raping another male who passed out during a booze-fueled pool party in Las Vegas, The Smoking Gun reports.
22-year-old Gustavo Banegas (pictured) pleaded guilty to felony charges associated with an attack that happened last August in a bathroom at the MGM Grand Hotel. Both he and his victim, a married man from Utah who was vacationing with his wife, were attending the hotel’s “Wet Republic” pool party.
According to police, they received a call when a hotel security guard walked into the bathroom and discovered “a Hispanic Male Adult who appeared to be attempting to have anal sex with an unresponsive White Male Adult.”

According to Banegas, he found the victim passed out drunk and “sitting on the toilet with his shorts pulled down to his ankles.” After lifting him off the pot and onto the floor, he became excited when he “saw the unconscious male’s penis.” He told police he became “immediately turned on” and “began to masturbate while standing next to the sink.”
As his excitement grew, Banegas said he became “so turned on sexually he stepped toward the unconscious male and knelt down next to him” to perform oral sex for “approximately 10 seconds.” Had the security guard not walked in, he said, he likely “would have sucked on the victim’s penis for a couple minutes more.”
Banegas admitted that he knew his actions were wrong, but he was so “turned on” by the “attractive” victim that he just “couldn’t help himself.”
This doesn’t quite jibe with what the security guard reported, however. According to him, when he walked into the bathroom, Banegas’ swimsuit was around his ankles and he had “a full erection.” The guard added that Banegas was “appearing to begin having anal sex” with the man.
The victim, who remained unconscious throughout the attack, says he is “unable to recall any other incidents that took place inside the restroom.”
Banegas is scheduled to be sentenced in August after pleading guilty to attempted sexual assault and coercion charges on April 14. He remains free on $100,000 bond.

In Spanish-speaking countries, informal homosexuality between men is widely accepted. In fact, it is much more widely accepted than in Anglo-Saxon countries.
In Anglo-Saxon countries, we have made it difficult for informal homosexuality to be accepted, especially between men. We have built up divisions and instructions as to how to behave. We have carved out territories for straights and other territories for gays. You cannot cross from one territory to the other without experiencing a guilt complex or being questioned as to your identity.
I would much rather mix in the Spanish model. It’s more accepting of informal homosexuality and it can produce ravenous scenarios such as when I was approached by a lusty Latin man who wanted to bite me all over.

The Police in New York City arrested a number of 50+ year old gay men who patronized a certain adult book store for prostitution and most of those gay men confessed (thinking that a public prosecution and trial would do more damage than the confession). 50+ year old gay men confessed to being prostitutes.
It turned out all of the arrests were part of a ploy by the NYPD to shut down the book store for allegedly promoting prostitution.

Without the allegedly voluntarily offered confession, there would be no case here. The alleged “victim” clearly couldn’t testify to anything and the results of the rape kit are listed as “pending” – i.e. no evidence of any rape.
This case would sorta come down to one in New York City in which a Transit Cop arrested a guy for allegedly sexually molesting a woman on the subway. The case went all through the system with the prosecution refusing to drop the case until it was time for the alleged victim to testify at trial. The alleged victim testified that she’d never seen the man before and that the claim that she was molested on the subway was embarrassing. IT TURNED OUT that the Transit Cops in NYC had a monthly quota to arrest x number of people. And, that the transit cop had fabricated the charges to get an arrest to meet her quota.

If there was actually a trial, how likely is it that the alleged victim would testify? The victim clearly has no idea HOW LONG he was naked in a public mens room (in hotel hosting a pool party for thousands of people).
Everyone here is ASSuming that the guy arrested was the only other person to enter the mens room while the “victim” was sitting on the toilet naked. What if the rape test does show semen but, semen from multiple men?

Either way, it’s non consensual, but still, there is a difference. The alleged perp admitted the non-consensual part, so why would he lie about the rest of his story?

Why is one man who had bad judgement regarding drinking (passing out with your pants down in a public restroom) being looked at differently than another man who had bad judgement regarding drinking (sucking without asking….or at least making eye contact.)

Wonder what the real story was. Have seen plenty of closeted married men lurking in men’s bathroom’s. Not saying if it was rape, that charges weren’t justified. Why didn’t victim get charged with public intoxication? Probably because it’s Vegas where smoking, drinking, gambling is encouraged, yet still a largely homophobic city. Perhaps the victim needs to come to grips with an alcohol problem. Do ya think? $100,000 bail really? Baltimore cops charged with murder had only $50,000 bail. Accused said he got aroused seeing victims penis. OK why was stall door open? And someone truly passed out on booze would not be on toilet with an erection..just assuming this since alleged said he got aroused by man’s penis. I only get aroused when penis is semi to full erect. We all know that booze and Vegas lead to debauchery and at least victim had foreplay. Whole case is comical. Anyone get pregnant? Fortunately it shouldn’t traumatized victim too much if he truly was unconscious. Remember “straight” former Sen. Larry Craig also was a buff of public toilet stalls.!

So this closeted straight married white guy who partying it up gay with a hot Latino stud is charged with raping him only because they got caught and he’s embarrassed. What were they doing together before the bathroom incident? If they were playing around before he passed out, then there may have been an implied consent.

It’s very relevant given the [alleged] rapist’s story. According to him, the whole basis for his actions is that he was so turned on, he couldn’t help himself. If he wasn’t gay, that couldn’t possibly be true. Only a gay man, whether repressed or out, would be turned on by another man. If he wasn’t gay, then the defense can claim impairment (ie with drugs) or even temporary insanity. As for the victim’s orientation, it too is relevant. Rapists sometimes blame mixed signals. Being straight makes it unlikely that there was even a hint of consent, ie that they had an agreement before he passed out. Given the orientational discordance, it becomes a simple [attempted] rape case.
