"Lawyers representing 14-year-old murder suspect Brandon McInerney were turned down by a judge Monday after they requested documents showing how Ventura County prosecutors decide when juvenile offenders will be tried in adult court. The attorneys filed the discovery motion seeking information about the standards and guidelines used by the Ventura County District Attorney's Office in determining whether to prosecute a minor in the adult or juvenile court systems." I always thought the decision to try this child as an adult stunk. This newest development makes it stink even more. If you're holding him to a standard, you MUST let his attorneys know the guidelines for the standard. Let's not compound the tragedy of young Mr. King's death by destroying another young life. Give BOTH these poor boys justice.

my emotional reaction says i want to kill the boy with my bare hands but the simple fact of the matter is this brandon mcInerney is evry bit as much the child as his victim i work with young people all day long & a 14 year old boy is exactly that a boy i think it sucks when our legal system tries to keep these kids children until theyre 18 or 21 but when prosecutors what to put on a show they suddenly become all draconian im with ajax give justice to both boys this story is tragic enough already give the attorneys ALL the information they need for a fair trial

Anyone who kills anyone deserves to be punished. Brandon deserves the death penalty for killing this innocent child just because of his sexual preference.

I hope he rots in hell for life and whatever pain he gets, he deserves.

Oh shut the pretentious trap.

This worthless piece of cowardly trash went home, found a gun, loaded it with at least two bullets, brought it to school, and shot the other boy in the BACK of the head TWICE. Completely unprovoked. If this wasn't first-degree, premeditated murder, I don't know what is.

A lot of 14-year old boys are stupid and immature. A lot are also very homophobic. But VERY FEW would go to the extent this piece of garbage did. 90% of kids his age knows that blowing the brains of another human being (another CHILD) out is a no no. His age is no excuse.

The piece of garbage deserves to spend at least 25 years in prison before he is eligible for parole….after he gets out, he can spend the rest of his life flipping burgers at McDonalds. And if it ever lives by me, i'll kick the shyt out of his worthless piece of existence.

Here's hoping the garbage gets butt plugged repeatedly in prison. Ha! How ironic….kill a gay kid, now get some gay lovin' of your own. Mwahahahahahahaha. Poetic justice. :)

How odd that the attorneys wouldn't have that information in the repertoire to begin with… how odd, too — that the judge would tell them they couldn't have it.

I suspect this river runs deeper than it appears.

I don't believe children should be tried as adults. 13-16 year old's are not "little adults," as is clear in fMRI research, etc. The U.S. has more individuals serving life in prison who committed crimes under the age of 18 than all other countries in the world combined. That, and a "hate crime" is always in the eyes of a prosecutor, jury, judge, i.e. "beholder." Sooner or later, some prosecutor will use a hate-crimes law to enhance the sentence of a woman who the prosecutor claims killed a man "because he was a man," or a gay person who kills a str8 person "because he/she was str8." We are better off to follow our UK cousins – murder is murder, and it means life in prison without parole, period. No 1st or 2nd degree, murder is murder and you spend the rest of your life in prison (the sane would work well for those committing rape (sexual assault). If someone asks me, "if a person raped your 13 year old cousin/sister/brother, etc, would I want them to spend the rest of his/her life in prison or be put to death?" the answer is "yes." That's why we don't allow family members of victims to decide the sentence of convicts.

To me, the idea of 1st or 2nd degree murder always seemed somewhat analogous to being a little bit pregnant.

When it's 2nd degree murder, is the victim only a little bit dead?
