Genre and other gay mags used to have a disclaimer at the bottom of the masthead that stated something like appearing in this magazine was no indication of a model's sexuality. I know some dropped that, but I don't/won't/can't (stomach) Genre anymore, so I don't know if that clause is still there.

Lawyers are supposed to be zealous advocates, and sometimes lawyers don't even have their clients read the complaint. Even if clients read the complaint, they sometimes don't understand it.

My neighbor is a public defender and he defended a guy who shot a gay man in the head point blank and killed him, after the hustler drove in the guys car for an hour. My neighbor argued the "gay panic" defense. You know, the dead victim had made a move on the murderer, so "he had to kill him".

My neighbor defends himself by saying as the attorney he has to argue any available defense, and since the judge permitted it, he had to do it. I no longer speak to my neighbor.

He's lucky there are semi-decent courts in his part of the world to sort this kind of thing out, though I think he's shot his livelihood in the foot on this one if he ever wanted to be an actor. Gay people get married these days so the implication of being homosexual is not defamation. Also the entire world is not always nice to attractive people. In some locations in the world like India and Pakistan, good-looking people in general who get uppity get disfigured such as having car battery acid tossed in their faces to put them in their place, especially when they have a rival for the affection of the same person. The world can be very barbaric.

There are too many details to know what to think, about permission, etc. I seriously doubt that the photog. would have used the pictures without permission of some kind. Most know that line. It sounds as if the case rests not on that fact, which would have been enough but on the kind of Magazine and the claim that that particular use for gay consumers is pagorative. I don't know if there is some kind of catch in Florida law requiring specific permission for that use. Depends on that, case law , and judge .
Most likely, young Massing wasn't too serious about being a model of any kind.

Okay, I've changed my mind on this issue now. Regardless of whether a release form was signed, the content of the suit is unnecessarily homophobic. If his case was ~just~ about consent and the adult nature of the magazine I would have supported him. But the suit goes further.

I am not a lawyer, but I am a trained paralegal.

I am a documentary maker, and am familiar with releases.

I am not the Rick Day named as defendant, however I have daily google search feeds with my name, and the defendants name comes up almost daily.

I have never met or talked to anyone involved in this case, as of this moment, nor do I expect to.

I own an events venue in Midtown Atlanta, GA which is known as a so-called' gay-ally venue.

I am a 53 year old married grandfather of 3 and consider myself a heterosexual. And yes, I grew up in the 70's.

My comments, regarding the case specifics: I will reserve opinion until I take the time to read the complaint, but a release is not the sole basis for a contract between two parties. It is a clause to an agreement. There are verbal adjustments, subsequent documentation and slight alterations to 'boilerplate' releases. Until we ALL see what caveats were agreed upon, in writing or otherwise, we should reserve snap-judgments as speculating to the validity of the complaint. What is valid in this case is what was agreed upon, and what kind of valid evidence will be presented during discovery.

My comments regarding some comments in this thread: It is reasonable to conclude that the Plaintiff could have known that the Defendant was primarily of the gay genre.I knew it is apparent by the daily name key worded internet search performed by google. Shame on Plaintiff, as some concluded.

However, the Plaintiff was the client, not a hunky model hired by the Defendant for a specific shoot in a gay publication. The intent of the Plaintiff as to the intended used of the product or service is the question for the judge.

Addressing damages, and the tut-tutting of some, as a straight man I can tell you that, although great strides are made in the reintegration of gays into general society, there is still a stigma within the straight (read vast majority) community, in which being mis-labeled or erroneously identified as potentially gay could indeed cause duress (social, mental and physical) that you, as gay men, can not relate. Why? Because you are gay and we are not (shrugs).

Straights can not say "I know how you feel to be persecuted for your sexual identity" without some justifiable doubt from a listener. The converse is valid, in my opinion. You can't just say "oh people may think you are gay, so what?" Who, amongst us, wants to be mis-categorized based on some mis-communication? Gay is still a 'put-down' in some work and social circles, including institutions of worship. I denounce this practices, while I unfortunately acknowledge its existence.

I've read a lot about this case since it first broke (for now obvious reasons). This web site and story is somewhat conveniently leaving out some details that are revealed in the others.

I speculate the Plaintiff had never intended to pursue a career in modeling, only acting. Fact of the matter is, he is a fine hunky young guy. In the end, that is all the client wants; a hunky guy to sell their product with his hotness. Clients pay the photographer to shoot the models they pick, not the other way around. So the talk of poisoning the well"for every gay he works for" for clarifying his sexual identity is moot. Is every gay person that vindictive toward someone who wishes to right a wrong?

Would any gay or straight man put up with his face posted on a web site that featured 'sexual offenders' because he 'looked like one'?

Sexual offender carries the same negative baggage as gay in some, if not many straight society. It is wrong, but it is there.

tl;dr, I know. In my opinion the facts are more complex than some in this thread are blowing off.

If there is a clause a) stating this is the sole agreement then Rick you wrong (I say this as a tranactional lawyer) and b) Even if not- there are other rules of transactional law which make this case unlikely to be a winnable one if there is a release.

I haven't read the papers filed with the court, so I don't know the particulars.

But here are some general observations.

Unless there's an agreement to the contrary, the photographer, not person being photographed, holds the copyright to the photos.

You don't need a person's permission to take his picture or even to sell it. Paparazzi routinely take candid photos of celebs without their permission and sell the photos to magazines. Yet you don't hear about lawsuits being filed by the celebs against the photographer or the magazine for unauthorized use of photos!
If such lawsuits ever upheld in court, the paparazzi and the entertainment mags would be put out of business.

Furthermore, the photographer is not responsible for how magazine presented the photos, e.g., originals, cropped, photoshopped or otherwise.
