Sorry to say so, but I think the judge is right.
It would be nice to open another window for people to get married,
but an injunction is just a temporary measure, conditional on the outcome of the trial. If the window closes again it would likely mean setting people up for grief when their marriages are declared null (since presumably the Supreme Court ruling wouldn't necessarily recognize marriages after election day).
Hopefully this challenge will be successful, and the door will opem legitimately and for real.
If not though, the last thing you need is more confusion and distraction from continuing the fight for marriage equality (presumably another referendum).
