Just moments ago, the New York State Court of Appeals decided not to strike down a gay marriage ban, leaving 44 gay couples whose cases were brought in front of the justices with mouths agape. The 4-2 decision handed down from Albany states "the New York Constitution does not compel recognition of marriages between members of the same sex." Judge Robert Smith "said New York's marriage law clearly limits marriage to between a man and a woman and any change in the law should come from the state Legislature." To be clear, the court did not say same-sex couples shoudn't be allowed to marry — but the state constitution did not require them to allow it.

Here in New York, the battle continues.
