Sanchez Investigation Around The Bend?
Will Gay Porn Past Bring Him Down?

majorsthisbig.jpg
The Marine Corp may be a mere signature away from a full-blown investigation into conservative solider Matt Sanchez's porny past. Air Force Times reports that Col. Stephen Brown currently has a form that would allow the Corp to delve into Sanchez's admitted career as a porn star. Sanchez claims that he hasn't acted in a gay porn since 1992, but that producers used footage up until 2006, thus making it appear as if he's been more active.

Regardless of his timeline, members of the Corp can be booted for appearing in gay pornographic material. Air Force Times says:

According to the Marine Corps’ Separation and Retirement Manual, “Marine reservists who act in pornographic movies while not in a drilling status are subject to administrative separation with an other-than-honorable discharge based on commission of a serious offense, that being indecent exposure.”
Apparently Sanchez isn't that worried. He says, "They'll have to do what they have to do... The biggest thing is owning up to it and moving on." Yes, well, you didn't really own up to it until you got called out. Also, as we said before, there ain't any moving on from this one, homie. We're not holding our breath for a conviction, though - rumor has it that Sanchez has already been told he's going to get off.

Sanchez may indeed get off... hopefully it will be without touching himself like he did in his Bjorn film.

I wonder how many military brass are "screening" the videos, you know, just to make sure that's him and all.

there's an "s" on the end of Corps, as in Marine Corps.

I guarantee he got special intervention from his Republican Representative. The key is that after CPAC gave him the award, they can't afford bad press from a 'gay-related' discharge. It's interesting because many other soldiers in the exact same circumstances, except they acknowledged being gay, had meritorious careers lasting decades ended immediately. Sanchez has only been in the Marines a few years. But his GOP connections were the key in getting him a special pass.

Will Sanchez get a free pass? He shouldn't. After all many gays have been outed and discharged with less evidence and no proof of their homosexuality other than what might be considered "hearsay" in a civilian court of law. Valuable members of the military, Farsi speakers , for instance have been summarily discharged for just allegedly being gay.

The body of evidence against Sanchez is not only recorded on video for public consumption, but leaves no doubt he performed homosexual acts in the past and past behavior is a good indicator of future behavior. Additionally, Sanchez not only acted in gay porn (longer than he acknowledges), he also worked and advertised himself as a male prostitute. He has distorted the dates and lengths of time in these pursuits, so his word is not very good.

Now there are several problems confronting the military. There is a better than average reason to assume Sanchez is in violation of several articles of the UCMJ (Uniform Code of Military Justice), namely Articles 125 and 134.

Article 125 covers sodomy, stating in part those : "that engage in unnatural carnal copulation with another person of the same or opposite sex or with an animal is guilty of sodomy. Penetration, however slight, is sufficient to complete the offense." Now it is my understanding that the penetration was more than slight, at least 11 inches by most accounts. And these numerous "acts" of sodomy are captured in living color on DVD.

Article 134, known as the "General Article" says that : "Though not specifically mentioned in the chapter all disorders and neglects to the prejudice of good order and discipline of the armed forces, all conduct of a nature that bring discredit upon the armed forces...shall be punishable at the discretion of that court."

Now since there is no absolute certainty that Sanchez engaged in sodomy while a member of the USMCR, there is good reason to suspect he has. Others have been discharged for merely having been seen entering or exiting a gay bar, not caught having sex, but exposed as a homosexual for the act of frequenting a homosexual establishment. Sanchez should be held to the same standards.

As for Article 134, there can be absolutely NO doubt given Sanchez's pornographic film appearances AND his public solicitation of male sexual partners for cash, brings discredit upon the armed forces, specifically the USMC. Whether Sanchez is in fact gay or not can be debated forever. He states he is not, others swear he's had a dating (not for dollars) relationship with them. I tend to believe Sanchez is not heterosexual, at the very least he is bi-sexual. He is somewhat evasive in this regard as well.

But the bottom line is, if there is any fairness and justice in the military, the required results are clear. Sanchez must be discharged under DADT, like so many others have been with lesser cause. If he is not, then I see a great potential for lawsuits alledging unequal protection. If Sanchez is given a break because of political influence, then I think DADT and in fact the UCMJ need to be thrown in the rubbish once and for all. What good are rules, regualtions and laws if they are not equally applied to all those subject to them?

I want to see how this plays out with the rabid right wingers and if former gay porn stars along with a host of others who have documented criminal records will be welcomed into the "new" privatized armed forces.

General Pace, this man is subject to your command, he's a member of your Corps and subject to your judgement of what is moral and immoral activity. Your call, Peter. The troops and the nation await your command decision.

Beasley says:

Just wondering, does Mr Sanchez receive benefits (tuition reimbursement, etc.) because of his military background. If so, I think he should have to pay it all back.
