GayTravel.com, a website this blogger has used once or twice, is launching a new (marketing) initiative it’s calling the “I Heart Campaign.” Users are encouraged to post their favorite love stories a handful of cities (New York, Miami, Las Vegas, Long Beach and San Francisco) for a chance to win a trip to their favorite destination. But just because the website is calling it “I Heart” instead of “I Love” doesn’t mean New York’s tourism board is going to appreciate it. Defending its trademark, New York State has filed more than 3,000 claims against everyone from T-shirt manufactures to big companies that try to hijack the heart insignia. And GayTravel.com blatantly uses it in its “I <3 NYC” graphics. So, um, enter the contest before it gets sued out of existence!

Seeing as they’ve taken a very simple concept and made an elaborate contest/campaign, I think they’ve crossed the threshold of originality required to get around a trademark infringement claim.
