Evangelical schmuck Michael Marcavage and his right wing pals are celebrating after Pennsylvania's Supreme Court struck down a gay inclusive amendment
to the state's hate crimes law:
Along with six other member of his Repent America organization, Marcavage sued a handful of state officials, including Gov. Ed Rendell, claiming the law was passed in violation of the Pennsylvania Constitution.

In its ruling last week, the Supreme Court essentially signed on to the opinion authored by Commonwealth Court Judge James Gardner Collins.
Collins said the bill signed into law by then Gov. Mark Schweiker in December 2002 "did not retain its original purpose as it moved through the enactment process."
In its original form, House Bill 1493 addressed "agricultural vandalism" and the "criminal offense of agricultural crop or livestock destruction." By the time it reached Schweiker, however, the bill had been gutted and rewritten to broaden the state's hate crime law.

Anti-gay activist and frightful human being Michael Marcavage and his Repent America allies just got a bit of smack. An federal appeals court ruled yesterday that Philadelphia police rightly arrested the group after they disrupted a gay event in 2004. "A three-judge panel ruled Tuesday that anti-homosexual activists had a First Amendment right to demonstrate. But the judges say they didn't have a right to disrupt speakers at the 2004 OutFest event… The appeals court says a video shows the group tried to drown out speakers at the event. The judges say the right of free speech does not encompass the right to cause disruption." [Fort Mill Times]

Repent America Succeeds In Appeal

The forces of evil won a legislative fight in Pennsylvania yesterday. Anti-gay group Repent America and mischievous leader Michael Marcavage got exactly what they wanted when a state court struck down gay-inclusive hate crime legislation.
A state court Thursday threw out language that expanded Pennsylvania's hate-crimes law to include crimes committed on the basis of the victim's sexual orientation or physical disabilities, because the restrictions were inserted into a bill that originally dealt with agricultural crimes.
Commonwealth Court's 4-1 ruling handed a victory to a conservative Christian group called Repent America, which filed a lawsuit in 2005 challenging the amendment of the state hate-crimes law three years earlier.

Marcavage and six other group members argued that the amendment was passed unconstitutionally because it replaced language in a bill that dealt with agricultural vandalism and crop destruction.
