Heather Lynn Martin Gartner and Melissa McCoy Gartner (a couple of married Iowan lesbos!) last week filed suit against a pair of state health department officials for listing their second daughter Mackenzie, who arrived in September, as a child born out of wedlock — when, silly, it’s just that she has two mommies. “The Iowa Department of Public Health in March rejected the couple’s request on grounds that Melissa Gartner had not legally adopted Mackenzie and was not biologically related.” Director Tom Newton says he’ll fight the charges, because without legal adoption papers, who’s going to look after the rights of the father?

First, the daughter cannot possibly be listed as being born “out of wedlock” given that her parents are legally married. Does not compute.
Second, typically offspring produced within a valid marriage have the legal presumption to be the offspring of the mother’s spouse. DNA tests and proof of biology aren’t required of either parent to demonstrate a biological relationship.
Unless Iowa has a peculiar law that requires male spouses prove paternity, there shouldn’t be any requirements that a female spouse prove maternity.
