Elena Kagan, the alleged lesbian U.S. solicitor general, is tops among liberals’ favorite candidates to replace Justice John Paul Stevens on SCOTUS. This website has pointed out that Kagan is not on anyone’s list of heterosexual favorite candidates. And last night on The Colbert Report, Stephen Colbert made a funny.

      Elena Kagan maybe gay but she does not deserve to be anywhere near the bench. She is right wing and believes incredibly disgusting things about detainee detention and believes that the “War on Terror” makes the whole world a battlefield. Gays may advance under Kagan but general civil rights will no doubt go backwards. How about a trustworthy legal mind like Harold Hongju Koh, Diane Wood, or Pam Karlan?

      How about we just leave identity politics out of it and pick somebody who’d be good at the job regardless of their race, gender, sexual orientation, diabetic status, and whatnot?
