Oh, Howard K. Stern. The former Anna Nicole Smith hanger-on just had a judge tell him that he can’t sue for defamation per se just because Rita Cosby alleged he’s a big homo. But the judge did say that allegations of having homosexual sex, however, could be defamation, but that’s for a jury to decide. In the book about Smith, ex-MSNBC anchor Cosby says Stern and Larry Birkhead got it on, and that Smith had a tape of it that she saw. So the $60 million libel lawsuit moves forward, with 11 possibly defamatory statements about gay sex still on the docket.

if what she put in the book is not true then the man has every right to sue. there was never any question he had the right to sue over what she put in her book.
if it isn’t true it is libel and the burden is on her part to prove what she said was true. she is sure to lose. this was just qibbeling.

If not, he’s going to win.
Not that he should. But if the jury is instructed to accept the premise that having gay sex is libellous, he’s bound to win.
I mean, gay sex? With Howie? It’s not like there’s a line forming.
For Howie, that is.
