Oh, the lengths some people will go just to get laid. The Guardian is reporting that a U.K. woman named Gayle Newland has been accused of pretending to be a man and duping a woman into having a relationship with her male alter ego that included sexual intercourse. The case is currently unfolding at Chester Crown Court with both women taking the stand and giving two different, and bizarre accounts of what transpired between them.
Newland, who is 25, has a fake online profile for a man she named Kye Fortune. She has admitted to the court that she created the male persona when she was 13 years old once she realized she was attracted to women but was unable to come to terms with her sexuality. She hid behind the Kye Fortune identity while she communicated with girls in online chat rooms and eventually created profiles for Fortune on MySpace and Facebook.
The victim, whose name is being withheld for legal reasons, has testified that she struck up an online relationship with Fortune on Facebook unaware that she was being catfished. After two years of cyberdating, they began to meet in person and have sexual encounters and were even engaged at one point, but the complainant never saw Kye. She willingly agreed to be blindfolded for the duration of all of their meet-ups because she was led to believe that Fortune was recovering from treatment of a brain tumor and did not want her to see him. It wasn’t until she removed the blindfold after a failed attempt at performing fellatio on Fortune that she discovered his penis was really a strap-on dildo — and that Kye was really Gayle.
“Every time I met up with Kye Fortune, I either had the mask on already or he would wait outside the door and I would put it on,” the victim testified in court.
Newland, however, claims that her paramour was always aware of her true identity and is in actuality a closeted lesbian. According to her, the two met at a nightclub a few years ago where Newland shared that she met women online using her Kye Fortune alter ego. Newland stated that the victim was a willing participant in their relationship and used Fortune to fulfill some sort of sexual fantasy through role-playing. As for Kye’s brain tumor, Newland explained that since “no one knew [the complainant] was gay” she fabricated the storyline as a way to prevent her family from meeting Fortune aka Newland.
Apparently, Mr. Fortune gets around. Shortly after Newland’s arrest, another woman came forward and revealed that she had also been catfished by the accused but figured out her true identity before meeting in person.
The case of she said, she said continues to play out in court. If convicted, Gayle Newland is facing five counts of sexual assault.

Legal action against Newland is bullshit. Putting aside the almost certain likelihood that Newland is gender dysphoric and trans instead of plain ol’ lesbian, the women claiming to have been sexually assaulted by a partner with whom they willingly and over an extended period of time communicated and physically engaged with of their own volition (including the ridiculous blindfolding)are being disingenuous at best, filthy liars at worst. My money’s on the latter. What is with this recent trend of females (it’s usually straight females vis a vis straight males)either explicitly or tacitly (as in continuing to remain physically engaged without being coerced, forced, threatened, etc) agreeing to a sexual encounter with another person and then after the fact claiming they’ve been sexually assaulted or raped. Not only are such claims utterly preposterous – and clearly false – but they also serve as a slap in the face to all those who have actually experienced the trauma of being the victim of a sex crime. The women accusing Newland of sexual assault and the corrupt prosecutors who agree to charge her with such crimes are prime examples of everything that’s currently wrong with the current generation of females and the justice system in general.

Merv, your contention of “no meaningful consent” is a non starter, at least in the first charges filed. The plaintiff was in communication with Newland for a period of two years. Upon meeting, plaintiff willingly and freely agreed to be blindfolded for the sexual encounter. Newland and plaintiff continued to meet and engage in sexual relations of this nature repeatedly and always with the explicit consent of plaintiff who never alleged Newland threatened, coerced, restrained or in any way, either explicitly or implicitly otherwise prevented plaintiff from preempting or withdrawing from sexual contact. To charge Newland with any sort of sex crime is not only a clear step backward for the law and rational thinking in general, but it also serves as enabling for those who would level such accusations under these or similar circumstances. Never before have our courts been so clogged with so much superfluous, self indulgent, pointless bullshit than they are now. It’s a sad commentary on the state of the human race as a whole.

@Kyle85: There was an actual case in California of a man, pretending to be a returning boyfriend, climbed into bed with a woman and had sex with her. She consented, at least until she realized it was not her boyfriend. Was it not rape because she consented?
At the time, it wasn’t rape under California law. Wisely, they changed the law to cover cases of rape by deception such as these. Rape by deception was real in the California case, and it’s real in this UK case.

Should people who lie about their income or marital status and who supposedly enter into sexual relations under those false premises be charged with “rape by deception?” I’m sure the extremely rare instance cited by Merv can be addressed in other ways.
