The significant issue is not Kim Davis or marriage licenses or gay marriage in general. The issue is the perversion of the concept of religious freedom.
The FACT is that NOT ONE elected or appointed official in this country, nor any political organization is trying to deny Christian fundamentalists the freedom to believe, practice and observe whatever religious dogma they choose. NOT ONE. No Christian fundamentalists are in danger of losing their freedom of religion as defined by the 1st Amendment, i.e., no one has attempted to pass any law “prohibiting the free exercise” of any religion, least of all Christianity.
What Christian fundamentalists and their Republican defenders are calling religious freedom is actually the imposition of their extremist religious ideology on the rest of the country. When they talk about the freedom to deny gay people marriage licenses or women birth control because of their religious beliefs and values, what they mean is that they want the freedom to discriminate against anyone who is not a Christian fundamentalist. Their claims have NOTHING to do with American principles of religious freedom and everything to do with trying to create an American society where Christian fundamentalism holds absolute supremacy over all other religious beliefs.
Any Presidential candidate who would swear to uphold the Constitution upon is election would be obliged to oppose these unConstitutional efforts by Christian fundamentalists to “establish” a state religion.

Mr. Ciccone is entitled to his opinion of course but it is a rather unimpressive one. Colorado and Washington have passed laws which have decriminalized marijuana at the states level. They did not nullify federal law and the feds can still act on the issue in those states if they desire to do so. The sanctuary law issue is a similar matter.
As has been pointed out repeatedly this woman is required to act as the clerk as elected by the people of her county. She has to serve all the people of her county not just the ones her follow her religious convictions. This is not the same as a Muslim woman wearing a hijab, a Sikh male wearing a turban or an orthodox Jew wearing a yarmulke. Doing so does not deny anyone else they civil rights. Now a Muslim woman refusing to issue wedding licenses to same sex couples, liquor licenses to stores and restaurants and a Jewish or Muslim clerk refusing to issue a business license to a butcher who sells pork products, not to mention a Sikh refusing to see a business license to any store which sells meat all would be in the same predicament as this woman. She is entitled to believe as she wishes but in the performance of her duties, she does not have the discretion to refuse to follow the law. The courts have ruled and she has been ordered to follow the law. She is refusing to do so and refusing to allow the other clerks in her office from doing so.

She was already offered a more than fair compromise–she wouldn’t have to sign the licenses and the subordinate clerks would issue the licenses (which is what’s happening now anyway)–and she just wouldn’t interfere. She rejected that offer, which is why she’s in jail.

It appears that it needs to be repeated on a daily basis that Kim Davis is not in jail for her beliefs, she’s in jail because of her behavior (insubordination and contempt of court). She, as a government employee, doesn’t have the right to impose her religious beliefs on her constituency. She’s also imposing her rigid beliefs on her staff. Her job is to make sure the licenses are in accordance, which she refuses to do with both straight and gay couples; hence the lawsuits from both gay couples and straight couples. If she doesn’t want to have gay people in her private life or if she, as a born again christian of only a few year who is still living in an adulterous relationship per her bible, doesn’t approve of same-sex marriage she can also go to the ballot box. She’s not doing her job, she’s inflicting a governmental barricade based solely on her beliefs, which (as Ciccone might say) “if i’m not mistaken, it’s in the constitution”.

The Judge told her she would be held in contempt unless she did her job. She ‘chose not to’ – NO ONE twisted her arm and made her rebel.
She’s allowed to pray in jail. She’s allowed to read her bible in jail. She’s allowed to speak with her attorney in jail. Her followers are being allowed to ‘gather outside’ and protest. Her husband is being allowed to support her both vocally and by his actions. Her Church is still allowed to be, to exist, to preach whatever it is that they preach. No one is coming to close it down. No one is coming to arrest the members because of their religion. Kim Davis is being allowed to make her appeals. No one is stopping her from doing this because of her religion.
Kim Davis is in jail because she refused to do her job and then in arrogance and pride (another sin) she ‘bites the hand that feeds her and her family’. Kim Davis is in jail because of Kim Davis. No Other reason.
