Montana’s Attorney General Wants Judge To Throw Out ACLU’s Domestic Partnership Lawsuit

Montana’s Attorney General Steve Bullock is asking a Helena judge to toss out a lawsuit filed against the state in July by seven gay couples (repped by the ACLU) that argues not offering domestic partnerships to gays is a violation of the state constitution — the same document that was amended to bar gay marriage. “Courts may not exercise the power to enact laws and revise, alter or amend the constitution,” Bullock says in his rebuttal, which is hinged on the constitutional ban prohibiting the state from recognizing any same-sex relationship. A Jan. 25 hearing will address Bullock’s request for dismissal.
