While I oppose his views:
A) A democrat will never pick up his seat; another republican will win the district in either a special election or the general election. And,
B) I do not believe drunk driving or extramarital affairs should ever make a politician resign. We all make mistakes in our personal lives.

Drunk driving is a very public, not private, crime that costs many sober, innocent people their lives, not to mention reflects the poor judgment of the drunk behind the wheel.
As far as sexual affairs of married politicians are concerned, I’m sure if Vito thought he could get away with it without it becoming the focus of the remainder of his term or ruining his chances of re-election by having his and both his family’s names dragged through the mud by his opponent then he wouldn’t resign.

I’m in agreement about drunk driving. It’s viewed as some type of small innocent deed but the consequences can be huge. He is playing with possibly the lives of several people in his car, other people’s car or random people on the street. Automobiles aren’t toys.

Gay people are not well served by allowing private morality panics to determine who can or cannot hold office. The cases of Spitzer and Larry Craig may be slightly different since it both cases laws were broken. But fathering a child out of wedlock is not illegal.
It is really shortsighted to get on the stupid bandwagon calling for his resignation.
As for drunk driving, that is illegal and it is a borderline case. I don’t believe Rep. Patrick Kennedy resigned for that. He went to rehab.
A little evenhandedness might be in order here, just out of self-interest if for no other reason.

Courts have a range of responses to drunk driving. People aren’t thrown in the slammer for their offense. They are often sent to rehab.
Yeah, drunks kill people on the road and in those cases the courts take it more seriously sending the drunk drivers to jail.
No one lost their life here, he didn’t kill anyone.
I would resist calls for resignation and also resist the tendency to brand all DUI’s as arch-criminals. The Virginia law under which he will probably serve some jail time is moronic.

I’m in complete agreement. And I’m sure First Wives Club, Scott, and most of the people branding Vito an indiscriminate criminal because of a DWI charge have also gotten behind the wheel once or twice when they weren’t supposed to.
It’s always harder to see hypocrisy in yourself.

Gee, Mike, nice to have such certainty. Why bother having elections. The fact is, everyone agrees that the seat is now “in play.” The district has been changing and, like most of the electorate, the voters are getting fed up w/GOP – yes, even on Satan’s Island and in Bay Ridge.

Hmm, verrry unlikely. Look at any targeting or polling data for Staten Island (which I do). Sorry to tell you the district’s solidly republican makeup has not changed. There are hardly enough swing votes to allow a democrat the chance.
Although, the best chance for democrats would be for Fossella NOT to resign and run on the November ballot. Republicans would certainly win a special election.

My point about drunk driving being a crime was in response to Mike’s assertion that it was part of his private life. For someone who’s career involves making and passing laws to turn around and ignore such a well publicized and infamous one not only speaks to his poor judgment but to his arrogance as well. But, I agree, it’s up to the voters in his district to decide whether or not they want him to represent them in his off time from partying and impregnating retired military personnel. But from what I’ve read, isn’t it his party leaders who are asking for his resignation?
I sincerely hope that whoever replaces him should he resign is better able to focus their energies on serving your district instead of self destructively medicating their guilt with alcohol because they’re betraying their commitment to their wife and children. I mean, there’s only so many hours in a day and the people who elected him deserve 110% of his undivided attention.

There is a presumption that all drunk driving laws throughtout the states are standardized and the same. Not so. The Commonwealth of Virginia has perhaps the toughest drunk driving laws and highest fines in the nation. Part of that reason has already been stated. Too many repeat offenders have continued to drive and too many people have been killed. In the case of Patrick Kennedy, the District of Columbia has different statutory standards.
What will happen in this case is that Mr. Fosella will be fined, placed on a year probation, lose the right to drive in Virgnia except in very limited circumstances, attend the Alchohol Safety Action Program (ASAP), get signatures from 12 step meetings, and Virginia will notify the State of New York of the Congressman’s legal status. There will be no exceptions and no immunity.
Secondly, regardless of the opinions about children born out wedlock, there is no question that this is adultery and that too is against Virgnia law. The man is married and unlike muslims and mormons, multiple partners are not legal in Virgnia. It might even be possible that the GOP attorney general of Virginia, Robert McConnell may have to charge the woman since it is she as a willing participant is the resident, not Forcella.
How the Commonwealth responds to Forcella himself is rich fodder for water cooler chats at law firms
This all may seem ludicrous but given the high involvement of the religious right in Virgnia politics i.e., the late Jerry Falwell of Lynchburg and Pat Robertson of Virginia Beach, etc., the Commonwealth has rigid and strict standards and definitions regarding what is a family and what it is not. Be mindful not long ago that a state court in Richmond tried to take a daughter from her lesbian mother which only stopped once Mary Cheney and Heather Poe began to live undisturbed in that republican redoubt of Mclean, Va.
