Elena Kagan has clearly stated her belief that there is no constitutional right to same-sex marriage. There is no chance for equality for gay people for the next twenty years because of the extremely young and extremely anti-gay court Obama and Bush have given us.
Remember when everybody was saying you had the vote for Obama because of the Supreme Court? How much better off we would have been there with a one term John McCain presidency and the two retired justices on the court until someone better than the current president was making the choices!
I will not vote for him again.

@Todd Shui: Dude, context please. She said that as she was being confirmed for Solicitor General and, from that perspective, it’s true. The Supreme Court dismissed Baker v. Nelson in 1971, so from the perspective of Solicitor General, who has to follow the laws as they are interpreted by the courts, her answer was correct.
Also, she did NOT say it was “her belief”. She said “there is no federal constitutional right to same-sex marriage,” which is currently correct given Baker. Once she’s a Supreme Court justice, she’ll be the one doing the interpreting, not following others’ interpretations and can find otherwise. I wouldn’t go apoplectic yet.

@Sam: Co-Sign. If you use the Googles you will her department has been very supportive of the Gays relating to DOMA and on the DADT. You are 100% correct there currently there is no federal constitutional right to same-sex marriage. Simply making that statement, she appeased 99.9% of the rightwing lunatics who would have put major roadblocks up towards her confirmation of Soliciter General.
I have been wary of SCOTUS nominees before, The Gaydar pings pretty substantially on her. And I am pretty certain we will have a Lesbian Sister on the SCOTUS for a good long time working on our behalf……….

I guess we all knew if America ever got a Gay Supreme Court justice it would be a lesbian, because heteros seem better able to tolerate the idea of two women having sex than two men.
