And, note, known “homosexuals” and “homosexual conduct” are STILL barred and they define “homosexual” as
A person, regardless of sex, who engages in, attempts to engage in, has A PROPENSITY to engage in, or intends to engage in homosexual acts.”
and, “homosexual conduct” = “homosexual act” which is STILL defined as:
“any bodily contact, actively undertaken or passively
permitted, between a Service member and another person of the same sex for the purpose of satisfying sexual desires and any bodily contact that a reasonable person would understand to demonstrate a PROPENSITY or intent to engage in such an act.”
AND the assumption is STILL that you’re guilty until you “prove” yourself innnocent; it’s your burden to “prove” a negative—that you DON’T have a “propensity” to have any “gay” “bodily contact.”
AGAIN, the ONLY good thing in the new regs is an ALLEGED ban on using confidential information, e.g., from a doctor.
BUT, as SLDN has confirmed:
1. “Gay and lesbian servicemembers who attempt to serve openly and honestly are still subject to discharge; being out to ANYONE at ANYTIME presents a risk to further military service.
2. Gay and lesbian servicemembers can still be ‘outed’ by third parties.”

It should’ve at least been that way from the moment it was enacted.
What a crappy consolation prize. With the “review” not due for completion until December, a month after Republicans either make gains or take congress back altogether, DADT will still be the law after Barack Obama is gone from office. An utter disgrace.
