Air Force Sgt. David Gutierrez, a twenty-year veteran stationed at McConnell Air Force Base , is being probed by the Air Force Office of Special Investigations over allegations he failed to disclose he’s HIV-positive to all the sex partners he met at swingers parties. Including dudes!
Gutierrez, 43, “engaged in numerous, unprotected sexual acts…over the course of three years” that count as “aggravated assault against several men and women in and around the Wichita, Kansas area” because he’s got The Hiv. His wife Gina says Gutierrez contracted the virus while stationed in Italy and told his sexual partners there; but upon being relocated to an American base, says an Air Force report, he stopped disclosing his status and thus violated the Uniform Code of Military Justice, relays the Smoking Gun.
[Gina] said that her husband used adult networking web sites to arrange “sexual encounters with both male and female partners,” and “bragged” to her “about his numerous sexual exploits in the Wichita area and commented he never informed the other parties of being HIV positive.” Online profiles indicate that Gutierrez’s wife has participated with him in swinging activity, both in Kansas and Italy.
[…] In his affidavit, [Air Force criminal investigator Derrell Freeman] disclosed having interviewed two women who reported having unprotected sex with Gutierrez after meeting him through adult web sites. Both women–whose names TSG has redacted from an excerpt of Freeman’s affidavit–told the Air Force investigator that Gutierrez never disclosed his HIV status. The names of both women appear among Gutierrez’s list of Facebook friends.
One woman told of first meeting Gutierrez in person last summer at a swinger party (she first connected with him through adultfriendfinder.com). The alleged victim, a 44-year-old Kansas woman with two sons in the military, said she performed oral sex on Gutierrez at that initial gathering, as well as at subsequent swinger parties over the following months. She added that he took photos and videos “every time these sexual encounters took place.”
The second woman, 44, told Freeman that she initially met Gutierrez in late-2009 via clubforeplay.com. During the Thanksgiving holiday she “engaged in unprotected oral sex and vaginal intercourse” with Gutierrez at his Wichita home. “At no time did D. Gutierrez disclose his positive HIV status” to the woman, Freeman reported.
It’s unclear whether these women have tested positive for HIV since their encounters with Gutierrez. But perhaps he didn’t disclose it because he came to the conclusion it wasn’t such a big deal.
In a June 2007 posting on adultfriendfinder.com, Gutierrez conducted a poll on whether respondents were willing to “play” with partners infected with herpes simplex virus (HSV) or HIV. In a follow-up post, he asked, “Why are people scared of the HIV virus, don’t you wear condoms to protect yourself from HSV?” He added, “The research I have done raises several questions on weather or not HIV is even related to AIDs.”
Maybe the Pentagon should send out a survey to servicemembers to see if they agree!

Geez, a lot of HIV news this week. Again, it shows that persons who suffer from self hate, in the closet and are in denial will act this way. What happens though is, it looks terrible on the Gay community. He obviously knew what he was doing and intentionally infected his partners.
This is a serious issue when it comes to HIV, we need to focus on going forward: revengeful carriers. I know what he is thinking, ‘I am going to infect everyone so we all can be on the same level playing field’. This is no different from suicide bombing.

Yes, lets call it his “dick of death”, then wonder why he’s ashamed to disclose, concluding that he’s a “revengeful carrier”. Real classy people. Even with heteros, you judgemental queens don’t miss a chance to contribute to a problem you clearly misunderstand. Obviously he should be prosecuted for putting others at risk, but your attitudes aren’t making it any easier for him.

I’ve heard this guy is straight and only picks up men for his wife. I’m from Wichita and have never slept with him and I think that I’ve done every bi guy in Wichita so he’s got to be straight LOL. Obviously, this asshole was very irresponsible. However, if there were any people that were actually infected by him, I would say they were just as irresponsible as he is. In a swinger’s situation (or any situation), people need to protect themselves. It would be the same result if he didn’t know about his HIV status. I’m not saying they had it coming, but they should know better!

Why is a silent, but savage, sexual predator like Gutierrez who’s been more than just a little busy spreading terminal STD infections given the bureaucratic luxury of having a hearing to discuss whether he’ll even have a court martial hearing, while more vocal bi or homosexuals who don’t act on their impulses (at least not in any illegal ways) find themselves expelled from the military more quickly than they can make a case for themselves, for as little as a single statement.
Could we perhaps say that Gutierrez has becomes the epitome of all that seems wrong with the “Don’t Ask Don’t Tell Policy?”

This is just plain evil. This is why people are scared to date someone with HIV. You would be in fear that they are trying to infect you all the time. Condom or no condom…I have been hearing of people “pretending” to wear condoms just to spread the virus. I think that there should be laws to help protect the negative community as well. So much is being done to keep HIV positive people’s health private when they can go around infecting people at will. I had a girlfriend whose ex was sleeping with other men and she used condoms with him so she thought. When he would turn off the lights, he would remove the condom for the “feeling”. It was not until she got sick that she discovered this. And who knows who else he has done that to. He should be in jail.

This is why people think twice about dating someone HIV+. You would be in fear that they are trying to infect you all the time. My girlfriend dated someone who lied about his status, provided fake HIV documents and “pretended” to wear condoms durng sex. He would remove the condoms after turning off the lights for the “feeling”. She disclosed her status to me immediately and I accept and love her. But because of her experience our sex life is non-existent. She is too afraid to transmit the virus and others are doing it without hesitation. There are laws protecting the HIV positive person health but they can go around infecting people and and jeopardizing theirs. This is not consenual sex. Yes HIV+ people have a right to a fullfilling sex life. But you also have a right to choose if you want to sleep with someone that is!

I wonder since Gutierrez is infected with HIV is his wife also? It sounds like she is just as guilty as him by encouraging him to participate in swing parties and swapping partners with him. She knew of his status too and didn’t inform the other 500 partners he was messing around with. I bet the women and men are testing negative right now for HIV but it takes time for HIV to develop in your system some people have tested negative for two years to have it show up later so I’m not so hopeful for all those he had sex with. This is an utter disgrace and he should be scared but you know what he lives in the USA where there are many free clinics for HIV/AIDS infected people to get free medication so in all honesty the government will be still paying for his meds through these free clinics.
