Hmmm, someone at the Natl. Conf. of State Legislatures doesn’t understand the legal difference between “gay marriage” and “civil unions”. While here in NJ we have civil unions that legally are supposed to be equivalent, they are not “marriages” in name or reality…yet.

It’s too bad that this doesn’t explain that the states that allow cousin marriages actually PROHIBIT cousins from marrying until they usually reach age 65. (The purpose of this age restriction is to prevent any children being born to the marriage.) So I’m not really sure that gay people should be using cousin marriage as an example, unless they too want to be prevented from marrying until they’re senior citizens.

If I’m reading Maryland’s code correctly, cousin marriages are legal with no age restrictions. Maryland’s code lists its exclusions in terms like “father’s sister” and “sister’s daughter” rather than “aunt” or “niece”. No restriction on marrying a parent’s sibling’s child. But you can’t marry your granddaughter’s husband for some reason and if you even try you can be fined $500.
DC also does not list “cousin” or “parent’s sibling’s child” in its code. But you can’t marry your grandparent’s spouse.

The legality of cousin marriage with age restrictions is a pretty strong argument in favor of same-sex marriage. One of the arguments that anti-marriage stooges trot out with regularity is that the state has a compelling interest in keeping SSM illegal because marriage is designed to facilitate procreation. That a particular state only allows one sort of marriage if there is no possibility of procreation puts a stake right through the argument. This came up at, I believe, the summary judgment hearing in the Perry case. The judge noted that the last couple he married were both well above 80 years old and asked the defendant if there should have been a procreative requirement imposed on that couple (who of course said no).

Fakename, I think I get what you’re saying, but correct me if I’m wrong. You’re saying that:
If a state can regulate marriage relationships, and likewise restrict certain relationships as part of that power (i.e., a state allows cousins to marry but only if they are beyond the age of reproduction) then obviously marriage isn’t just about making children.
Right?
Yet equally obvious is that a same-sex marriage relationship can’t biologically produce children, either. (Not unassisted by an outside party, anyway). This inability to procreate is similar to an infertile senior cousin relationship, so therefore gays and lesbians should also be allowed to marry.
Is that where you’re going?
Except NOW you’ve got a huge problem, and that’s whether gay/lesbian couples should be allowed to raise children. Cousins aren’t allowed to, and it’s within the state’s interest to regulate child-raising so that cousin relationships CAN’T raise children. Are you really advocating that same sex marriages should be legalized on the basis that they should also similarly be prevented from raising children?

No, not in any possible way. I’m saying that cousin marriage laws invalidate in part a state’s contention that its interest in helping to create an optimal environment for child-raising is so compelling that SSM must be denied to its citizens. Even the Obama administration, in its brief in the DOMA case, has acknowledged that child welfare is not a compelling federal interest in re sederal recognition of SSM.

The USA’s…hollier than thou policies should look at this very closely before creating laws to refuse US gays our natural born rights to US sovereignty. However for states like Hawaii we need to see this as cultural. The Hawaiians have been doing this well before becoming a state and it was honorable as the only culture in the US whose history of “Royal” sovereignty required it as law. Additionally, Hawaii was the only state where gays or the mahuu was treated as royalty in the house of the Royals whose jobs were as scribes to the Kings and Queens, and chiefs. The fight to win back Hawaiian soverignty is a fight to win back our respectable place as the mahuu in Hawaiian culture. True Hawaiians shame on you for turning your back on your culture that once ruled your lands and for what…Primo Beer, plate lunch, shave ice, pot, crime, lies, the common cold, welfare and Mormon living. Don’t tell me that I don’t know what I am saying because as one-half true Hawaiian with Royal heritage as it was scripted by the mahuu of times past…I do know.
