More crappy news for admitted child molester and antigay activist Josh Duggar. According to In Touch, he was recently served legal papers while working at his used-car sales job in Siloam Springs, AR.
The papers were from Los Angeles-based DJ and photographer Matt McCarthy, who alleges Duggar used a stolen picture of him to create a dating profile on the Ashley Madison cheating website back in 2015. As a result of the theft, McCarthy says, he’s lost of work, been harassed in public, and suffered “prolonged pain and embarrassment.”

McCarthy first announced he was considering legal against against Duggar back in August 2016. He made good on that promise last week when he filed the papers with a Los Angeles court.

The bad news comes just days after the woman who outed Duggar as a child-molesting sex addict back in 2015, resulting in his family’s epic fall from grace, finally broke her silence and revealed her identity.
In an effort to manage the onslaught of horrible publicity, the Duggars released a hasty statement the other day saying they were “delighted” to announce Josh and his wife, Anna, are expecting their fifth child together. They made absolutely no mention of the lawsuit or any of the bad press Josh has been receiving.
A court date for Duggar and McCarthy’s case is scheduled for May 15.

What are the chances of success in a suit like this? I wonder if the strategy is just to embarrass him until he settles out of court. (Especially considering that he’s still on TV.)

I guess it all depends on how well he proves the damages, and that’s not easy to do. He may have been the butt of a few jokes, but it seems unlikely that he would have lost business given that it’s the Duggar name that’s been vilified, not any image. And unless his face (or Duggar’s face) is tied to his business in any meaningful way, I don’t see any impact. At most, he can sue for unwanted publicity, copyright theft and identity theft. But none of those amount to any concrete damages.

Bryguy, I’d just like to point out that his losing business only has to do with Duggar due to the fact that Duggar used his likeness. Just having his face associated with Ashley Madison would be reason enough to lose business, as some clients might look at that as immoral.

The problem is proving the damages. The Ashley Madison connection is especially tough to prove. I consider myself an average American consumer. I watch as lot of media, and am online much of my time awake. Yet I have never seen an Ashley Madison profile (and for what it’s worth, I’m straight, so it has nothing to do with the site not catering to gays). The private site has a very specific audience so it’s HIGHLY unlikely that that one of his potential customers would be a Madison member AND remember his face. Furthermore, keep in mind that it’s a heterosexual site, so the only people viewing Duggar’s profile (with his photo) would be women. That cuts the population in half (and I’m willing to bet that there are way more men on Ashley Madison than women). In other words, the chances of anyone seeing his photo, much less remembering it, is very very very slim. And of that very small population, how many would refuse to do business on moral grounds? That’s what the plaintiff has to prove.
He may argue, of course, that all the publicity after the news broke, has affected his work. The problem is that he is the clear victim so if anything, the reporting has gained him public sympathy. I can’t imagine him losing any business for being the victim.
I hate the Duggars and am personally publicity-shy so I sympathize with him. But if i was a juror on his case, I’d very likely vote against him for lack of evidence.

I don’t think anyone involved in that family should procreate. Reading different things about the family and the church they belong to, there needs to be a think like the Amish do, where they get to spend a few years in the modern world before deciding what they want to do with their lives. These people think prayer and physical labor (which is what Josh Duggar was doing after his father found out about the molestation). And, btw, a cop in Arkansas was also told about it, but the guy was associated with the family, and only had a “stern talk” with him. That cop was also later convicted on child porn charges (not sure if it was possession or creation) so he might’ve just gotten off on it.

Josh is a nightmare, but it also shows the damage these religions do to kids. Gee, why was he cheating on his wife? Oh I don’t know, maybe because he was forced to get married at 19 after having no experience dating in the world. How many people should end up with their first girlfriend or boyfriend? NOT many of us.
So you are now going to have his 15 or 20 kids raised by creepy unhappy parents who are told to have as many kids as possible to vote for conservatives.
That while quiver full movement should be investigated.
