A federal appeals court has upheld a ruling ordering a Kentucky county clerk to issue marriage licenses to gay couples.
Rowan County Clerk Kim Davis objects to same-sex marriage for religious reasons. She stopped issuing marriage licenses the day after the U.S. Supreme Court overturned state bans on same-sex marriage.
Two gay couples and two straight couples sued her. A U.S. district judge ordered Davis to issue the marriage licenses, but later delayed his order so that Davis could have time to appeal to the 6th circuit. Wednesday, the appeals court denied Davis’ request for a stay.
“It cannot be defensibly argued that the holder of the Rowan County Clerk’s office, apart from who personally occupies that office, may decline to act in conformity with the United States Constitution as interpreted by a dispositive holding of the United States Supreme Court,” judges Damon J. Keith, John M. Rogers and Bernice B. Donald wrote for the court. “There is thus little or no likelihood that the Clerk in her official capacity will prevail on appeal.”

April Miller and Karen Roberts were one of the gay couples who sued Davis. Miller read the ruling on her phone in the living room of the house they share down a country road on the outskirts of Morehead. Roberts, her partner for more than a decade, peered over her shoulder, smiling, humming, tears welling up under her glasses.

The news flashes across their TV screen and they hugged, and their hug turned into a brief slow dance on the living room rug. The phone started ringing, but they ignored it for a minute.
They felt vindicated, they said. They got out the boxes holding their matching wedding bands, bought days after the Supreme Court’s decision in June. They are simple white gold bands, ringed in diamonds.
“One step closer,” Miller said. “We might be able to get married in September.”
Mat Staver, an attorney for Davis, said he was disappointed with the ruling. He said he plans to discuss options with Davis, including an appeal to the U.S. Supreme Court.
“The court of appeals did not provide any religious accommodation rights to individuals, which makes little sense because at the end of the day it’s individuals that are carrying out the acts of the office,” Staver said. “They don’t lose their individual constitutional rights just because they are employed in a public office.”
It’s unclear how Davis will react if she were to ultimately lose her appeals. She testified in federal court last month she would “deal with that when the time comes.” Saturday, she spoke to thousands of supporters at a religious freedom rally at the state capitol, saying: “I need your prayers … to continue to stand firm in what we believe.”
“Regardless of what any man puts on a piece of paper, the law of nature is not going to change,” Davis told the crowd.
Miller and Roberts said they know the legal fight will stretch on. Davis continued to refuse to issue marriage licenses after other judges’ rulings. And they suspect she will continue to refuse after this one.
“We get all excited. But we know a letdown is coming again,” Miller said. “It’s going to keep going. It’s gonna be a long haul.”
“But it felt so good for a minute,” Roberts chimed in.

Irregardless of her personal, religious beliefs, she holds an elected office, and she was elected to provide a service to the people who elected her. The services she’s charged with rendering include the issuing of marriage licenses to couples in accordance with state and federal law. The law states that homosexual couples are entitled to a marriage license just like straight couples. Her personal beliefs have nothing to do with the issue since she chose to run for this office. Should she object to the duties she’s charged with, then she can choose to resign her office. That’s what a clerk here in MS did. Though, she did it to make a stink; she had already announced she wouldn’t be running for re-election in November. If she continues to refuse to do her job, then honestly she should be found in contempt of court and she should also be removed from office. Though, removing her from office would be a little harder than ‘firing’ her because that would require that the electorate vote her out according to the election laws of Kentucky. Though i do hope to see her either thrown in jail for contempt of assessed large fines for the contempt.

This is just another example of what ‘The Rule Of Law’ means to Southerners: it means my religion is the law and to hell with you. I read an article a while ago that centered on ‘Where America would be without the influence of the southern states; it’s conclusion, in a nutshell, was that America would be a more fair, prosperous, progressive country. It’s hard to argue with that conclusion. How much does the discrimination by southern whites cost the rest of the Country? Cutting non-whites out of the political and economic rights that they enjoy in the rest of the country has got to be very expensive for the rest of America. Think how many people are not able to get a good education from the public schools? We know that the less education your have, the poorer your economic opportunity is. Look at how hard the southern states are pushing to get rid of the Voting Rights Act; an act the Congress put in place because of the past and continuing discrimination that goes on wherein certain states have ‘blocked’ or made it more difficult for African Americans to vote. Add to that the harassment places like Ohio put on African Americans to keep them from voting (this is well documented, republicans had operatives harassing ‘certain’ voters about their ‘eligibility’ to vote as the voters were trying to enter the polling place). But what can you do to right the wrong imposed by altering the voting pool to be more favorable to right wing wing-nuts? You can’t go back are have a revote, which is the only way to get it right. How could anyone display the Confederate Flag in anyway manner at all knowing what it stands for?

The question is ‘Why haven’t her superiors taken any action to remover her from her office or to circumvent her personally, so that marriage license can be issued? She isn’t the final arbitrator as to who gets a marriage license. The United States Supreme Court, the superior Court in the land per the Constitution had ruled on this case already; The Federal District Court has told her to issue marriage licenses (although a federal judge should know better about allowing her to ignore a ruling from the Supreme Court while she appeals); the Conservative ‘Court of Appeals’ has upheld the district court’s order. So how does anyone think that an appeal to the Supreme Court on overturning that very Court’s order makes any sense at all? This battle has been fought, the final decision has been rendered. This is not ripe for further litigation. The District Court should issue an order that marriages licenses be issued to qualified couples forthwith upon pain of contempt. The Federal District Court can overrule anything in Kentucky law (such as it it) and it’s high time they do that. If marriage License licenses are not being issued as of Monday morning at the normal hour of opening of the office to issue such licenses, then the District court must take action to ensure that they are being issued by the end of the day.

The judge’s ruling is sound and logical. This woman indeed has 1st amendment rights, and the gov’t can’t force her to change her mind or creed. But that’s not the legal argument here (in fact, the whole ‘religious exemption’ legislation movement misses the point, and blurs the line between public office and private industry). It’s the fact this woman represents the citizens and laws in county she works for. If she can’t support those laws, and can’t execute her duties, neutrally, in the public interest (not via her own personal prejudices), she should be removed from her position.

giraffus is dead on with his/her comment. Her personal and religious beliefs should not influence the execution of her duties. If I were a resident, I would be questioning who is paying for the Attorneys fees for these court cases, I bet their tax money is. She should go to jail for that alone.
