It doesn’t always pay to go rogue, as Kim Davis has just learned. The bitter, embattled Rowan County clerk, who has become possibly the most despised woman in the United States due to her illegal refusal to issue marriage licenses to same-sex couples, has just been found in contempt of court and taken into federal custody.
A defiant county clerk was sent to jail for contempt Thursday after insisting that her “conscience will not allow” her to follow a federal judge’s orders to issue marriage licenses to gay couples.
“God’s moral law conflicts with my job duties,” Rowan County Clerk Kim Davis told U.S. District Judge David Bunning. “You can’t be separated from something that’s in your heart and in your soul.”
The judge said she left him with no alternative but to jail her, since fines alone would not change her mind. A deputy escorted her out of the courtroom, although not in handcuffs, to be turned over to the custody of federal marshals.
“Her good faith belief is simply not a viable defense,” Bunning said, noting that allowing an individual’s beliefs to supersede the court’s authority would set a dangerous precedent.
“I myself have genuinely held religious beliefs,” the judge said, but “I took an oath.”
“Mrs. Davis took an oath,” he added. “Oaths mean things.”
Hundreds of people chanted and screamed, “Love won! Love won!” as word reached the dueling crowds outside.
The judge also told all five of the clerk’s deputies, including her son, Nathan Davis, that they are free to issue licenses to all applicants while Davis is held in contempt, but would also face fines or jail if they refuse to comply. He told them to meet with lawyers briefly and consider their fates before returning to his courtroom later Thursday to reveal their decisions.
A lawyer for Davis, whose defense is funded by the Liberty Counsel, a religious freedom group, argued that the deputy clerks cannot issue licenses against Davis’ authority, but the judge overruled this objection.
Before she was led away, Davis told the judge that she can’t comply with the U.S. Supreme Court‘s ruling legalizing gay marriage nationwide, because it conflicts with the vows she made when she became a born-again Christian.
“I promised to love Him with all my heart, mind and soul because I wanted to make heaven my home,” Davis said during about 20 minutes of emotional testimony. She described how she became a Christian and said she is unable to believe anything else.
April Miller, who was denied a license four times at the clerk’s office, also testified. She said she voted for Kim Davis last year and that she has no desire to change the clerk’s personal beliefs.
Outside, demonstrators shouted at each other, sang hymns and waved signs, which ranged from the violent — turn to Jesus or burn — to simple statements of support. A small plane flew over the courthouse, carrying a banner that said: “Stand Firm Kim.”
Davis stopped issuing licenses to all couples in June after the Supreme Court ruling. She’s lost at every federal court level since then, but continues to turn couples away.
“I have no animosity toward anyone and harbor no ill will,” said Davis, an Apostolic Christian, in a statement this week. “To me this has never been a gay or lesbian issue. It is about marriage and God’s word.”
Her critics mock this moral stand, noting that Davis is on her fourth marriage.
Davis served as her mother’s deputy in the clerk’s office for 27 years before she was elected as a Democrat to succeed her mother in November. As an elected official, she can be removed only if the Legislature impeaches her, which is unlikely in a deeply conservative state.
Judge Bunning is the son of Jim Bunning, the Hall of Fame pitcher for the Detroit Tigers and Philadelphia Phillies who served two terms as Kentucky’s junior U.S. Senator. Former Republican President George W. Bush nominated David Bunning for a lifetime position as a federal judge in 2001 when he was just 35 years old, halfway through his dad’s first term in the Senate.
But Bunning has been anything but a sure thing for conservative causes, ruling in 2007 to overturn a partial-birth abortion ban, and in 2003 to allow a Gay-Straight Alliance to meet on their high school campus.

My heart goes out to the Judge….I can almost hear the intake of breath from some and the shocked cries of “What??!!” from some others but, assuming the Judge is vaguely normal of course, he was placed in an unenviable position from which he was unable to extricate himself. The average Judge would above all seek to avoid martyrising this sad lady if the law allowed but Missie had positively sought what she knew would be a custodial sentence, thus pandering to her very misguided religious pretensions. A martyr is not truly characterised as fervent, pious person who longs to throw himself to the lions for the sake of the Lord. A true Martyr will, after doing everything possible to avoid the ultimate sanction, willingly accept to pay the final price as a last resort. This lady could easily have chosen a sideway’s move rather than a full-frontal in-your-face act of defiance of any Court’s Order. Sensible, God-fearing people do not easily defy Judges! Arrogant and self-satisfied people may but a Christian will not. To issue a licence to marry, in accordance with the Law, does not condone whatever it is to which this lady objects. Her job is to act according to law. She refuses to do her job and moreover brings the office she holds into disrepute. Now is the time to fire her. The only sadness here is far from her plight but the very real prospect she will soon be rolling in money. The Devil certainly looks after his own.

Out of six Rowan county clerk deputies, 5 have agreed to give out marriage licenses, only one had hold out, Davis own son, not surprising the son is every bit as crazy as the mother is,

The judge will not incarcerate him because the other clerks have agreed to do their job.
Also when the county clerk is not present in
office a local judge can issue marriage certificates.
So yes Rowan county is now issuing marriage certificates to all.
As far as Kim Davis, she will remain in jail until she agree to issue marriage certificates or until she is removed from office for misconduct or her elected official term is over, what ever comes first.
Under charges of misconduct, Kim Davis will not receive her pay because did not perform her duty.

Her past is NOT going to win her over with the religious right once they stop long enough to look at what she is now claiming. That being she is here to serve god. Liberty Counsel is not charging Davis for their services, they’re either providing them pro bono or they’re being paid by a right wing group.
Ms. Davis is still receiving her $80,000/yr salary. If she resigned or impeached the salary, of course goes away. She was employed as a deputy clerk – under her mother – for years. As such she may be able to draw on her pension, or be able to draw it at a later age. (I have no idea of Kentucky’s policies are and am guessing)

Liberty Counsel is a husband and wife not for profit law firm which provides services for free. They do fund raising with other weak minded right wing fundamentalist Christian would be Taliban members. Last year they pulled in almost 4.4 million dollars, half of which went into their salaries and personal expenses. They will be do great out of all this.
Kim on the other hand may not do so well. The state AG is considering filing criminal charges against her for her actions. If she is convicted of a crime then she will not get her pension if she is removed from office due to the conviction. I am unaware of Kentucky law but I have been told she will not receive any salary while incarcerated since she is not working and performing her duties.

Because Davis is in jail for misconduct (not doing her job–read the judges’ ruling on the oath she took) and the county prosecutor has filed the two charges of official misconduct against her…Davis is NOT BEING PAID. You are correct, her pension, under Federal Law, is protected…even if she is terminated (as long as she’s vested).
As far as the “pizza guy” and the “Kleins” are concerned, well that’s all changed. As of April, the rules at gofundme.com have changed. Go to their website and you will see that persons who are convicted of a crime or those who discriminate are prohibited from using their site to raise funds.
Bitch ain’t gonna be as rich as you may think…Liberty may not charge, but there will be court costs, civil litigation and perhaps additional fines to follow.

That video went viral. Liberty has already said that they offered all their services Pro Bono so there’s no disagreement there.
The point is: Liberty won’t make her house payment, insurance payments, utilities, car payments, child support, alimony, STD (MEDICAL) BILLS, court costs and any other incidental fines that the court may decide to impose. The court can also charge her the cost of incarceration for each day that she is in jail.
Who cares if she’s a HERO to the religious right. How many other Heros has the religious right praised? That asshole Pat Robertson? How about the past pope who hid all the molesting priests? Who cares what the religious right calls a hero!

Thanks Youarekiddingme. Alarmist or not, I “grew up gay” during the days of Anita Bryant, Jerry Falwell and a whole host of other gay haters (including Ronald Reagan by the way). I have monitored right wing antics for nearly 40 years at this point. Like radical Muslims and ISIS, right wing faux Christians have a long range goal in front of them. It is unlikely they win or rule the day, but keep in mind marriage equality made it by only one Justice. The other four Justices are Roman Catholic. Thomas’ wife is a Teabagger. And Thomas hates the fact he is a white man in black skin. Those four represent a collective fascism.
The fact Matt Staver, head of Liberty Council has taken on the Davis case pro bono comes as no surprise. But, it demands our vigilance. Those folk hate us with a vengeance, some calling for massive extermination of gays. While it is unlikely that will ever happen, we can’t sit back casually ignoring such clarion calls to “kill the gays”. I remember the days when “Kill a Queer for Jesus” was a popular mantra among fundamentalist Christians (all the while half of them likely taking it up the booty). I refuse to sit on the curbside assuming “all is well” when it fucking isn’t. And I leave you with this:

I believe like you, that we can never be too lax in our attitude about those around us who hate us. You’re not paranoid if there are indeed people who want to do you harm. People have vocalized (and continue to) that they do not want gays around. The numbers are dwindling, but they still exist.
There are 3 more county clerks in Kentucky still refusing to issue marriage licenses and a judge out of state refusing to marry on grounds of sexual orientation. It’s clear there’s still a ways to go.

Anita Bryant was the catalyst for my catapulting into gay rights groups in DC in the very late 70s to much of the 80s. I had the fortune of meeting Frank Kameny, a pioneer in gay rights within the federal government. I served on the board of directors of two separate gay rights group; then in the early 90s writing columns for two small gay rags. After that I entered graduate study at seminary and later became ordained. (I continue as a senior management executive in the private sector.)
When I came out with my first partner in 1968 the very idea of getting married did not even exist. For a while, when we went to gay bars to visit with friends it was against the law for us to even touch one another! If caught, we could be put in jail. Long ago I gave up trying to explain “gay” to people who already have closed their minds on the topic. I once was asked by a black woman, “Why do y’all have to claim your sex? Unlike me, you can hide from what you are.” I was stunned, but that told a lot in a few simple words.
Young gays and lesbians today take for granted the freedoms you and I actually did not enjoy when in our 20s to 30s. I do not blame them for taking their liberties for granted, but I do EXPECT them to take note of the evil hatred that has its hold on a certain segment of society and culture; and, to step up to fight it. Kim Davis is merely the tip of the iceberg comprised of faux Christians who hate us with venom and viciousness. I learned long ago not to get too comfy. This battle is not over, and it is one which we must win: period.
