How did a routine noise complaint result in a gay Staten Island man being dragged from his home by NYPD and beaten outside his front door?
That’s what Louis Falcone, 31, and his lawyer are asking in a lawsuit alleging a violation of Falcone’s civil rights after the June 19th incident.
The way Falcone tells it, a loud argument he’d been having with his brother triggered the complaint, but by the time police arrived, the dispute was already over.
Officers asked Falcone to come outside, to which he responded “for what?” Then his dog started barking, and according to Falcone, an officer yelled for him to quiet the animal or “I’ll fucking kill it.”

Then things escalated, and the officers dragged Falcone outside and began beating him. Video footage (below) taken by a neighbor confirms this.
“They threw me against the concrete in front of my house. My first reaction was to try to get up a little bit,” Falcone said.
“While I was on the ground, I had mud and blood in my mouth. One [of the cops] said, ‘Don’t let it get on you, he probably has AIDS, the faggot.’”
Falcone had a boot on his foot following a recent surgery, and says the cops intentionally stepped on it to inflict more pain.
“They’re hitting me for no reason. One puts his knee on my neck. They were all piling on top of me… I said, ‘Please, I just had surgery on my foot. One of the cops stepped on my foot. Another cop comes and steps on my head,” he continued.
Falcone said he was left with “a broken nose, two black eyes, cuts to his face and body, and…more foot surgery.”
His attorney, Eric Subin, said the officers “belong behind bars.”

Time and again the NYPD is caught harassing gay individuals and establishments, especially on dates that are important to the community. But as soon as one of their goons grinds himself up against a man at Pride, we immediately forget that. And by “we”, I mean Queerty and all other gay media outlets, whose raison d’être seems to be nothing more serious than providing readers some fleeting titillation.

The guy and his brother had a little fight by the time the cops showed up the fight was over and everything was fine. Cops went into the house and pulled him out and beat him … that is called breakin and entry plus assault and battery, those cops are the real criminals and they need to be fired and thrown into prison !!!

if he can prove that cops entered his home without a warrant and dragged him out and beat him, the “anti-gay charge” seems unnecessary. In a civil suit, the “language” the cops used (if recorded) can be uses to show hostility toward the victim, which seems to be enough in an of itself. Isn’t this “hate crime charge” only a condition in a criminal investigation by the police?

@Ladbrook: Knowing how corrupt the NYPD really is, the only way to get a conviction is to throw as many things to the jury as possible and hope one or more of them stick. The more ammo Louis’ lawyer can use in the initial hearings, the better off for their case. I would also say that Louis needs to leave the city immediately until it’s his time to go to trial. Knowing what those Staten Island thugs did to Ramsey Orta, the man who filmed Eric Garner’s murder, he’s going to want to go into the witness protection program right about now. They retaliate and they just found their next victim of personal targeting.
This little episode ought to wake the community up. With killer cops more emboldened then ever, it was only a matter of time before they started targeting people other than black and latino men and women. Now that it’s hit closer to home, will the community demand justice? Perhaps, but they’re still up against two anti gay catholics in power; Bill de Blasio and Bill Bratton. Both worship anti gay Cardinal Timmy Dolan and both are known to be major liars. I hope their bigotry is enough to throw their asses out, but they won’t be leaving their jobs without a fight. Thankfully, they’ve made enough enemies along the way where their time is short. It’s for the best that the white gays in New York realize the NYPD isn’t their friend either. Copagands at pride parades doesn’t change the truth for what it really is.

This is NOT the way to respond to a request from the police. Even in Oklahoma you don’t get smart with them. That probably pissed them off since they were responding to a complaint about a fight. Doesn’t sound like they were “harassing gays” at all.
It hard to see exactly what transpired but surely they could have done this without wrinkling his chiffon, though.

Have you ever heard of the fourth amendment? Last I looked it hasn’t been abolished yet.
People who believe we should ask ‘how high’ the minute a cop orders us to jump are about as much of a problem as these crooked cops themselves who expect people to give them deference and who care little for actually abiding by the laws tax payers are paying them to protect.

The problem is, the prosecutors and the cops all work together, so they will not peruse criminal charges. If the Civil trial brings out tons of publicity it may force them to charge them, but they would let them off with a light sentance. Lucky a neighbor took that video.

I wonder if the neighbor with the camera is the one who called the police in the first place. I’d also like to hear what the caller said when calling 911. Since there were two males arguing in the house, why did police pull out the first male they came in contact with. Did the police know him? Did they already know he was gay? So many questions. When I read a gay (transexuals are mutilated gays/lesbians and they must abolish sex changes) bashing case in the news, I wonder what the view is of the journalist reporting this on homosexuality/lesbianism. I also wonder if the journalist is a homosexual or lesbian and if so, are they setting aside their bias and reporting the news with no problems. I do not trust news that I get from Daily Kos or the Huffington Post on their coverage of gay bashing cases because they predictably make the homosexual look like an innocent victim no matter what wrong the gay does.
Gay bashing victims will face the same public opinion court as gay bashers. If there are ugly truths about a homosexual which the media omits as most did with Methew Wayne Shepard, then we will use our free speech rights to tell the ugly truths about the homosexual even if others dislike it. & there is nothing any1 can do to legally stop us from telling the ugly truths.
